General Terms and Conditions of Sale
Article 1 – Preamble
These General Terms and Conditions of Sale (GTCS) apply to any booking made via the website www.hotelmir.fr («the Site») by a Customer («the Customer»).
By making a booking the customer fully and unreservedly accepts these GTCS.
The Customer of the site www.hotelmir.fr acknowledges, prior to and expressly at the time of making any booking, that they have read and unreservedly accepted these general terms and conditions of sale.
Our Hotel reserves the right to adapt or modify these general terms and conditions of sale at any time. The terms and conditions applicable to a booking are those published on the Site on the date the booking is recorded.
The terms applicable to the booking of a room or a service by a customer are those in force on the day of the booking.
The essential characteristics of the accommodation offered, the prices and the accommodation availability dates are presented during the booking process.
Article 2 – Scope of application of the general terms and conditions of sale – Purpose
These general terms and conditions of sale comprehensively define all rights and obligations between the company HOTEL MIR and the Customer wishing to purchase services offered for sale on the website www.hotelmir.fr. All the booking terms for rooms in our hotel between our hotel and the Customer shall be governed by these general terms and conditions. They govern all stages of the sale, from placing the booking to the warranty of the products ordered, including payment, delivery and the Customer's right of withdrawal.
We inform you that, insofar as you book one or more rooms in our hotel online, your agreement to the content of these terms and conditions does not require a handwritten signature.
Our hotel regularly updates the text of the terms and conditions of sale and asks its guests to consult the version in force on the day of booking.
For this purpose, the guest has the option to download, save and reproduce the terms and conditions.
The option to book rooms and services at our hotel on the Site is reserved for private individuals, that is to say people who are not seeking to satisfy their professional needs.
Article 3 – Booking
The guest may book, on the Site, for personal use and for their own needs a maximum of four (4) rooms per booking. For bookings relating to business groups, meetings, seminars, etc., please contact us by telephone.
In using this site, you declare that you are at least the minimum legal age and have the legal capacity to enter into a contract.
The booking is deemed accepted by the guest at the end of the booking process.
To confirm a booking, you must first identify yourself. To that end, you complete, according to the instructions provided to you online, a form made available to you in which you provide the information necessary for your identification.
Article 4 – Booking process
Bookings made by the customer are carried out via the dematerialised booking form available online on the Site.
The booking is deemed concluded upon receipt of the booking form or booking request by our hotel, or upon online prepayment by credit card.
Any booking process follows the following steps : • you tell us the criteria of your request • we propose one or more offers • you choose the offer that suits you • the summary of your booking is displayed (details and total price) • you check and, if necessary, correct your booking • you finally confirm your booking after accepting our general terms and conditions of sale • you may be required to make payment for your booking via a secure method • a detailed confirmation of your booking is displayed on screen (to print and keep) • you will receive within a maximum of one hour a detailed confirmation of your booking at the e-mail address you provided to us. The reserved stay is only definitively secured once you have received our confirmation.

Article 6 – Cancellation or amendment by the customer
In accordance with Article L. 221-28 12° of the Consumer Code, the customer has no right of withdrawal as provided for in Article L. 221-18 of the Consumer Code.
The terms of sale for the reserved rate specify any possible cancellation and/or modification conditions for the booking.
When the terms of sale for the reserved rate allow it:
Cancellation of the booking can be made directly on the website; ;
Modification of the booking can be made directly with our hotel, whose telephone contact details are specified on the booking confirmation sent by email.
In the event of interruption of the stay, the full agreed price will be charged. In the case of a prepaid booking, no refund will be granted for this reason.
Unless otherwise stated in the rate chosen by the guest, they must vacate the room before 12:00 on the day the booking ends. If not, an additional night will be charged.
Article 7 – Stay at the hotel
The guest accepts and undertakes to use the room responsibly. Any behaviour contrary to good morals and public order will lead our hotel to ask the guest to leave the establishment without any compensation and/or without any refund if payment has already been made. If no payment has yet been made, the guest must pay for the nights stayed before leaving the establishment.
The guest accepts and undertakes to comply with our hotel's House Rules. In the event of the guest failing to comply with any provision of the House Rules, our hotel will be obliged to ask the guest to leave the establishment without any compensation.
Article 8 – Eviction
In the event that, for reasons beyond its control, our hotel is unable to honour the booking made, it will make its best efforts to rehouse you at its expense in a hotel of at least equivalent standard located nearby.
Article 9 – Liability
The photographs shown on our hotel's Site are not contractual. Although every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate our hotel give as accurate an overview as possible of the accommodation services offered, variations may occur, notably due to changes of furniture or possible renovations.
Our hotel cannot be held liable for non-performance or poor performance of the booking in cases of force majeure, actions of third parties, actions of the guest, notably unavailability of the internet network, inability to access the website, external intrusion, computer viruses or in cases of prepayment not authorised by the cardholder's bank.
Our site contains links to other websites over which we have no control. Our hotel is not responsible for the content of such third‑party sites that you choose to visit by clicking a link from our site.
Any booking or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the guest will result in the cancellation of the booking at the guest's expense, without prejudice to any civil or criminal action against them.
Article 10 – Complaints
Complaints relating to non-performance or poor performance of hotel services must, under penalty of forfeiture, be notified to our company in writing within eight days after the date of departure from the hotel directly to the hotel or to the Customer Service contact details shown above.
Article 11 – Prices
The prices relating to the booking of services are indicated before and at the time of booking.
Prices shown are per room for the number of person(s) and the selected date.
Prices are confirmed to the customer as amounts including VAT, in the hotel’s commercial currency (which in some cases may differ from the hotel’s local currency), and are only valid for the period shown on the Site.
If payment at the hotel is processed in a currency other than that confirmed on the booking, any exchange fees are payable by the customer.
All bookings, regardless of their origin, are payable in the hotel’s local currency, except where specific provisions are indicated on site.
Unless otherwise stated on the Site, extra services (breakfast, bed and breakfast, half-board, full-board…) are not included in the price. Unless otherwise stated in the Mobile Services, breakfast is not included in the price.
The tourist tax, shown on the rates page, is to be paid directly on site to the hotel except in the case of prepayment online where this amount may be included.
Prices take into account the VAT applicable on the day of booking and any change to the applicable VAT rate will automatically be reflected in the prices shown at the date of billing.
Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices shown at the date of billing.
Conversion into foreign currency is provided for information only and is not binding. Only the currency confirmed at the time of booking is guaranteed (if this currency differs from that used at the hotel, any related charges will remain the responsibility of the customer).
If a rate requires payment at the hotel on arrival or departure of your stay, and the customer’s currency is not the same as the hotel’s, the rate charged by the hotel may differ from that communicated at booking, taking into account possible changes in exchange rates between the booking date and the hotel stay dates.
Our hotel, upon confirmation of the guest's reservation, will indicate the total amount of the booking.
Rates may be increased by various taxes depending on cities/countries. The Guest agrees to pay the different taxes, without any dispute against our hotel.
Article 12 – Payment
The payment provider is solely authorised and responsible for the choice of bank cards accepted as a method of payment for a booking on the site.
By providing their bank details, the Guest accepts in advance and unconditionally that our hotel proceeds with the secure transaction. The Guest therefore authorises their bank to debit their demand account for the records or statements transmitted by our hotel or by any company designated by it, even in the absence of invoices signed by the account holder.
For any card payment on our site, the electronic certificate issued by the payment manager shall be proof of the amount and date of the transaction as well as the electronic archiving means implemented by our establishment. In this regard, the server's dates and times shall be binding between the parties.
An invoice will be issued to the guest at check-out.
If, for any reason (opposition, refusal by the issuing centre…), the debit of the amounts due by the guest proves impossible, the reservation will not be recorded by our hotel.
The amount due by the guest is the amount shown on the booking confirmation sent by e-mail to the guest.
Payment will be made, according to the rate appearing in the T&Cs, either directly at the hotel, on site, or by prepayment.
Our hotel reserves the right to refuse any reservation in the event of an existing dispute with the guest, in particular in cases of: full or partial non-payment of a previous reservation by the guest, where a payment dispute remains, refusal of card payment authorisation, non-payment or partial payment, if the guest has engaged in fraudulent activity, or for any other legitimate reason. Our hotel's liability can in no way be engaged in this regard.
At the time of prepayment, the amount debited at booking includes: the price of accommodation, accommodation-related taxes, the cost of catering if breakfast is selected, catering-related taxes and any other additional services selected by the guest.
In the case of a rate subject to online prepayment, the sum paid in advance, known as the deposit, is debited at the time of booking.
Article 13 – Cancellation or failure to present at the hotel (No-show)
The cancellation conditions and the consequences of the guest's failure to present at the hotel depend on the rate chosen by the guest and are described in the General Terms and Conditions of Sale (no-show).
Article 14 – Respect for privacy
Our Site is committed to protecting your personal data and your privacy.
During your visits to our site, we may ask you for information via forms or when creating your customer account. Information requested, marked with an asterisk, is mandatory. It is necessary for processing your requests. This information is intended for our hotel for the purposes of registering and processing your bookings and managing your customer account.
All data provided to our hotel is intended exclusively for our establishment.
Please note that when you make a reservation, our hotel collects personal data. This data is necessary for processing your reservation and may be communicated in whole or in part to the hotel's contractual partners strictly for the purpose of executing the reservation.
We may also ask you, by email, to provide proof of your identity and address, and possibly a scanned copy of the front and back of your bank card partially masked (under no circumstances should you disclose the security code), in order to protect you from fraudulent transactions. Through these supporting documents, we guarantee you better security by ensuring that you are indeed the owner of the bank card used.
If you fail to produce the requested supporting documents or if the documents provided are not convincing and do not allow our hotel to verify the identity of the person who made the booking, the reality of the domicile, or the apparent solvency conditions, our hotel will be entitled to cancel the booking.
In accordance with the French Data Protection Act of 6 January 1978, you have at any time a right of access, rectification and objection to all your personal data by writing, by post and proving your identity, to our establishment at the following address: 25, rue Vincent Mir – 65170 SAINT LARY SOULAN or to the following email address: [email protected].
Depending on the choices you made when creating or accessing your account, you may receive offers from our hotel. If you no longer wish to receive them, you can request their cessation at any time via your customer area or by writing to us at the following address: [email protected].
Please note that this automated processing of information, in particular the management of users' email addresses, has been declared to the CNIL under number: No.1970174.
Article 15 – Evidential agreement
Emails shall be proof between the parties, as shall the automatic recording systems used on the Site, notably regarding the nature and date of the booking.
By express agreement, electronic communications are regarded by our hotel and by the Client as having probative value equivalent to that of written documents.
Our computer records, kept under reasonable security conditions, shall constitute proof of communications, bookings and payments made.
Article 16 – Force majeure
Force majeure means any event outside the parties that is both unforeseeable and insurmountable, preventing either the client or our hotel from performing all or part of the obligations provided for in the contract. Events usually recognised as force majeure or fortuitous events by the case law of French Courts and Tribunals are considered such.
Neither party shall be liable to the other for failure to perform its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends the performance of their reciprocal obligations for the parties and that each party shall bear the cost of expenses arising therefrom.
Article 17 – Applicable law
These Terms and Conditions of sale are governed by French law without prejudice to any mandatory protective provisions that may apply in the consumer’s country of residence.
Article 18 – Entire agreement – Scope of these T&Cs.
These Terms and Conditions of sale, the terms of sale for the rate reserved by the client, and the voucher or reservation request constitute the entire obligations of the parties.
No general or specific conditions communicated by the client may be incorporated into these terms and conditions.
If one or more provisions of these terms and conditions are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and effect.
